What are the most problematic areas for construction professionals and developers?
Contractual risks and the insurability of projects are problematic areas for many developers and construction companies. Contract reviews and insurance facilitation are critical components of an effective risk mitigation and management program. Insurance facilitation assumes the probability that accidents or issues with delivery will occur and seeks an efficient way of distributing and/or transferring the risk.
What is "construction defect mitigation?"
Construction defect mitigation is a set of detailed investigations to determine the root cause and origin of alleged construction defects, research on current and past building code conformance, reviews of manufacturer's recommended installation requirements and specifications and adherence to those requirements and specs, and reviews of construction industry standards that are applicable to the element of work under investigation.
Performing construction observations, indentifying deficiencies, and then performing observations again to show that those deficiencies have been corrected, shows due diligence on the part of the owner or developer that the building is being constructed in agreement with codes and approved construction documents.
This process creates a set of documents which will aid in the defense of any future litigation.
What is "risk management?"
Risk management is objective professional advice to help mitigate loss exposures and minimize the total cost of risk, which can be in the areas of contractual, financial, operational, organizational, insurable, etc.
What causes a construction defect?
Construction defects are the result of inadequate and/or faulty workmanship, failure to conform to code, or material and/or product failure. Construction defects are identified during a thorough condition assessment by a qualified and certified building inspector.
What is a benefit of working with a risk management professional?
An independent construction/inspection professional performs building inspections and condition assessments that can help drive down the total cost of risk and make a positive impact on a client's bottom line.
